Do not submit sensitive, regulated, or confidential data through this Site unless we explicitly provide a secure method and have confirmed in writing that the method is approved for such data.

Examples include (but are not limited to):

  • Medical/health information (PHI)
  • Government-regulated or contract-controlled data (e.g., CUI/FCI)
  • Credentials/passwords

If you send such data without an approved secure method, you do so at your own risk.

In no event will AGCM’s total liability for all claims relating to the Site exceed $100 USD (or the minimum amount permitted by law, if greater).

You agree to defend, indemnify, and hold harmless AGCM and its officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of the Site.

14) Governing Law / Venue

These Terms are governed by the laws of the state where AGCM’s principal place of business is located, without regard to conflict of law principles. You agree that any dispute arising from these Terms will be brought in the state or federal courts located in that state, unless otherwise required by law.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

AGCM — SMS/Text Messaging Policy (Teams Phone SMS)

AG|CM does not share, sell, rent, or disclose mobile opt-in data with third parties for marketing or promotional purposes.

This SMS/Text Messaging Policy (“SMS Policy”) governs AGCM’s use of business text messaging, including text messaging enabled through Microsoft Teams Phone (or similar business messaging tools), and applies to employees, contractors, and authorized users (“Users”).

1) Purpose

The purpose of SMS at AGCM is to support business communications such as:

  • Scheduling and coordination
  • Time-sensitive updates
  • Basic customer service and project coordination
  • Appointment reminders and logistics

SMS is not intended to replace formal communications, secure channels, or contract notices.

2) Scope

This SMS Policy applies to:

  • Any SMS/MMS messages sent or received using AGCM-managed numbers, accounts, or platforms
  • Any business texting conducted on behalf of AGCM
  • Any text communications with customers, prospects, vendors, or partners

3) Consent / Opt-In Requirement (Important)

AGCM will only send business text messages to external recipients when we have appropriate consent, which may include express consent or express written consent as required by applicable law.

Because AGCM currently does not have an established SMS opt-in program, AGCM will implement one or more approved opt-in methods before initiating outbound texting campaigns or recurring messages. Approved opt-in methods may include:

  • A written consent form (digital or paper)
  • A website or electronic checkbox with required disclosures
  • A text-to-join keyword flow (where supported)
  • An email confirmation workflow documenting consent

No mass texting, marketing texting, or recurring messaging may occur without an approved opt-in workflow and documented consent.

4) Required Disclosures (When Opt-In Is Implemented)

When AGCM requests consent to text, the following disclosures must be provided (as applicable):

  • The types of messages to be sent (e.g., appointment updates, project coordination)
  • Message frequency (estimated or “varies”)
  • “Message and data rates may apply”
  • Opt-out instructions (e.g., reply STOP)
  • Help instructions (e.g., reply HELP or contact marketing@agcm.com)
  • Link or reference to this SMS Policy (when feasible)

5) Opt-Out / STOP Handling

Recipients must be able to opt out at any time.

  • If a recipient replies STOP, END, CANCEL, UNSUBSCRIBE, or similar, Users must:
    • Stop texting that recipient (except for a one-time confirmation if needed)
    • Record the opt-out in the approved system or CRM (if used)
    • Escalate any uncertainty to marketing@agcm.com

Users may not attempt to override or ignore opt-outs.

6) HELP / Support

If a recipient replies HELP or requests assistance, Users should provide:

  • The AGCM contact email: marketing@agcm.com
  • A brief description of how to opt out (“Reply STOP to opt out.”)

7) Prohibited Content — No Sensitive or Regulated Data

To reduce risk and protect clients, AGCM SMS must never be used to transmit or request sensitive, confidential, or regulated information, including but not limited to:

  • Passwords, authentication codes, MFA codes
  • Financial account numbers, payment card information
  • Social Security numbers, driver’s license numbers
  • Medical/health information (PHI)
  • Government-controlled information (e.g., CUI/FCI), export-controlled data, or confidential client deliverables
  • Any information labeled “confidential,” “restricted,” or subject to contractual security requirements

If such information is needed, Users must direct the recipient to an approved secure channel (e.g., secure portal, encrypted email, file-sharing system, or contract-approved method).

8) Professional Conduct / Acceptable Use

Users must:

  • Use professional language and maintain respectful communications
  • Text only during reasonable hours unless urgent
  • Avoid harassment, discrimination, threats, or inappropriate content
  • Avoid sending repeated messages without a response
  • Use SMS only for legitimate business purposes

AGCM reserves the right to monitor, audit, and retain SMS communications for business, legal, and compliance purposes as permitted by law.

9) Marketing Texts (Additional Restrictions)

Marketing or promotional SMS messages require:

  • A compliant opt-in process with documented consent
  • Clear disclosures and opt-out instructions
  • Review/approval by the designated business owner (or marketing/compliance)

If consent is not clearly documented, do not send marketing texts.

10) Recordkeeping & Retention

Where feasible, AGCM will retain text message records for operational, legal, or compliance needs. Users must not delete or intentionally evade retention controls. If retention is managed by platform policy, Users must comply with those configurations.

11) Security Requirements

Users must:

  • Use only AGCM-approved tools/accounts for business texting
  • Protect devices with passcodes and follow AGCM security policies
  • Report lost/stolen devices or suspected compromise promptly
  • Avoid texting from personal numbers for business purposes unless explicitly authorized and governed by a BYOD policy

12) Violations / Enforcement

Violations of this SMS Policy may result in:

  • Suspension of SMS privileges
  • Disciplinary action up to and including termination/contract termination
  • Legal action where appropriate
